Across The Street From The Ocean, short drive to White Sand Beaches Hale Ke Alaula, a large 2 bedroom, 2 bath home, has enormous square footage, vaulted bamboo ceilings and a huge wrap around deck. Comfortable furnishings, top of the line appliances, gourmet kitchen and Air Conditioning! There is a king size punee on the downstairs patio…if you have a couple of teenagers that want an outdoor sleeping experience in Hawaii! The master bedroom has a beautiful adjoining bathroom with a walk in shower and double sinks. The second bedroom is very private because of the layout with the living room and kitchen in the center of the house. The beautiful gourmet kitchen is open, so that you can converse with your family and friends while you are preparing meals. There is a large flat screen TV in the living room with a DVD player. You can check your email or surf the web on the deck with high speed (fiber optic Gigabit internet) Wifi. Beautiful teak dining table seats six on the deck and there are teak chaise lounge chairs, too. Enjoy outdoor dining with the gas grill for your fresh island catch. Great for a family, two couples or just a romantic getaway for two. You can see Mauna Kea from the back and the ocean is just across the street for daily snorkeling or diving. The largest white sand beach on the island is just 5 minutes by car and there are five star resorts near by with golf, spa and other amenities. Great surf spot at the end of the street and the whales are visible from November through April. PUAKO is still the only ocean front residential community along the Gold Coast/Kohala Coast of the Big Island nestled between the Mauna Lani Resort, Fairmont Orchid and Mauna Kea/Hapuna Resorts. Hapuna Beach State Park has earned the reputation of being one of Hawaii Island's finest beaches. It is the largest White Sands Beach on The Big Island and consistently rates on Top Ten lists internationally. Hapuna Beach offers some wonderful opportunities for swimming, bodysurfing, bodyboarding, sunbathing and snorkeling and is just a mile from Puako. You can even drive the back road to Hapuna Beach and not get on the Highway. Local shore fisherman can be seen daily enjoying the great reef fishing. Puako Beach Drive has no through access which keeps it virtually still undiscovered by many. There are six separate "beach" accesses along this stretch of beach. Although there is not a tremendous amount of sand, there are tide pools and the extensive protected reef is remarkable. During low tide, small pools dot the entire coastline and these pools are filled with small sea life that make excellent areas to explore for all ages. If you enjoy shore diving, kayaking and snorkeling you can find a spot along this stretch of shoreline to enter the water. Offshore the reef is home to a wide variety of fish and many days you will see dolphins playing right from the shore. Enjoy the Whales who return each year to mate and give birth in the tropical warm waters during the winter months. It is the responsibility of the renter to be familiar with all policies within this agreement. This rental agreement is entered into by and between the renter, hereinafter referred to as “Guest”, and Island Beach Rentals, LLC., (IBR LLC.) hereinafter referred to as “IBR”. CANCELLATION POLICY AIRBNB’s FIRM Cancellation Policy allows full refund for cancellations up to 30 days before check-in. If booked fewer than 30 days before check-in, full refund for cancellations made within 48 hours of booking and at least 14 days before check-in. After that, 50% refund up to 7 days before check-in. No refund after that. In the event of serious illness, depending on barring limitations that are out of our control and/or imposed directly by the property owner and/or respective booking platform where you made your initial reservation, Island Beach Rentals MAY be able to: • Defer your payment schedule • Reschedule your dates • Offer a partial IBR dollar credit to be held (hold duration for credit to be confirmed) on file directly with IBR to be applied against a future booking for the same property. • Offer a partial dollar refund IF IBR is able to rebook most if not all of the dates originally booked. 2. CHECK-IN AND CHECK-OUT Property will be ready for Guest on Guest CHECK-IN DATE. CHECK-IN TIME is 3PM. CHECK-OUT TIME is 11AM. Often times our bookings are back to back so it is essential that Guest respect these times. It is extremely important that Guest adhere to these times unless special arrangements have been made. Guest will be charged for an additional day if not approved for a late check out. Our housekeepers are on a schedule to prepare for the next arrival. Request for early check-in or late check-out will not be accepted unless arranged and paid for prior to arrival. Either option is based on availability due to instated PAUSE between bookings to support special COVID-19 cleaning procedures and property rest between guests. A (24 )HOUR pause has been instated for all bookings. 3. CHECK-OUT PROCEDURES Upon checking out please: • Leave the home neat and tidy. Please leave the home in same condition as arrival. • Lock all the doors. • Close all windows and louvers. • Please remove all trash to outside containers or take to trash site located on premises. • Wash all dishes. • Please leave sheets/bedding on the beds. Please don’t leave damp or wet towels in a pile. • Turn off all lights, fans and air conditioning (if air conditioning provided). Guest shall leave the Property in good order. Guest will be charged by the hour if the property requires any cleaning time over the customary time to clean it. If excessive cleaning is needed, it will be considered damage and shall be deducted from the Credit Card on file. 4. REACHABLE PERSON During Guest stay if a concern arises please contact the assigned reachable person to Property as indicated on this rental agreement or on site at Property. IBR asks the Guest to communicate any issues with Property right away. IBR will do their very best to rectify any situation as soon as possible. One way IBR is able to keep their properties in good repair is by guest feedback. IBR does not want Guest to have to deal with burnt out light bulbs or anything that is not in working order. Call the assigned reachable person to Property to report any issues. 5. NON-LIABILITY/INDEMNITY OF OWNER AND/OR ISLAND BEACH RENTALS, LLC. The owner of the Property and IBR will not be liable to Guest or any other persons on the Property for any damage or loss occasioned by any service provided by the owner or IBR under this Rental Agreement; or by electricity, plumbing, gas, water, air conditioning, sprinkler or other pipes and sewage systems, or the loss, interruption or stoppage thereof, or by the bursting, leaking, overflowing or running over of any tank, washstand, closet, waste or other pipes in or the Property, nor for any damage occasioned by water coming into the Property from any source whatsoever, or for any damage or injury arising from any acts or neglect of the other occupants of, or any other persons on, the Property or of any adjacent property, or of the public, unless such damage or loss results from a wanton and willful act of the owner or IBR or owner's or IBR’s gross negligence. All property of Guest and the other occupants of, or any other persons on, the Property shall be kept or stored at the risk of Guest only, and Guest shall hold the owner and IBR harmless from any claims arising out of damage to the same. In no event shall owner or IBR be liable to Guest or the other occupants of the Property for any loss, damage or injury, or any claims or demands therefor, on account of any loss, damage or injury to any person or property, including any injury or loss to Guest, whether caused by the negligence of owner or IBR or any one of them, or otherwise arising out of the use or occupancy of the Property described in this Rental Agreement unless such loss, damage or injury shall result from a wanton and willful act of owner or IBR or owner's or IBR’s gross negligence. Guest shall indemnify and save owner and IBR harmless against and from any and all claims, damages, costs and expenses, including reasonable attorney's fees, arising from the use or occupancy of the Property described in this Rental Agreement by Guest or others with the consent of Guest. Our vacation rentals are our owner’s personal homes and condos. They are generous enough to offer their private properties in paradise to travelers. Just as Guest home is not perfect, neither is the owner’s private Property. There may be a maintenance issue that we are not aware of or something may break during Guest stay. We will do our best to correct the problem within (2) business days (1 business day if possible), because in Hawaii there are very limited services on the weekend. No refunds will be issued for maintenance issues unless there is a major problem and the owner agrees to it. Please know we repair everything the housekeepers and guests report to us on a consistent basis. OWNERS AND MANAGER TO BE HELD HARMLESS The owner and the owner's managing agent accept no liability for any claims whatsoever arising out of the guest occupancy. GUEST hereby agrees to indemnify, defend and hold harmless the owner and the owner's agent for any and all claims, damages, losses, INCLUDING WITHOUT LIMITATION, ANY ACCIDENT, INJURY OR DAMAGES TO ANY PERSON OR PROPERTY OCCURRING IN, ON, OR ABOUT THE SUBJECT PROPERTY OR ANY PART THEREOF ON PROPERTY, BEACH, POOL OR BODY OF WATER ADJACENT THERETO AND USE IN CONNECTION THEREWITH. BE CAREFUL DURING HIGH SURF! Ocean conditions can be dangerous, high winds and high surf and high tides are cause to be cautious and enter at Guest own risk. If there is water sports gear or bicycles on the Property AND Guest is permitted to use them, the Owner and the Manager have no liability, see above. Please notify IBR immediately of any damage to the unit or grounds. Guest agrees to hold owners and IBR free and clear of any liability for damage to self or Property, resulting from accident or injury, or loss of enjoyment, due to power outages, rain, sun, flood, wind, surf, negligence, defective construction, fire, theft, inoperable appliances, equipment, pool, hot tub/spa, etc. The management will respond and attempt to repair or replace anything that may break down in Guest vacation home as soon as possible. It is understood that IBR will do it’s best to maintain, address and rectify any concerns prior to and during Guest visit however IBR does not guarantee use of all equipment, appliances, pool, hot tub/spa, etc. during Guest visit. There may be interruptions and or disruptions to use of equipment, appliances, pool, hot tub/spa, etc. due to unforeseen circumstances such as inclement weather as well as the unavailability of a vendor, parts and/or supplies needed to address and/or rectify concerns of Guest. Please keep in mind that being on a remote island in paradise sometimes keeps us from getting parts and repairs completed as timely as Guest might on the mainland. Please note that should this occur, NO REFUNDS OR DISCOUNTS will be offered or honored. It is understood that not all properties provide equipment and/or a pool. There are no guarantees regarding such equipment as to condition or availability. Often times previous guests may leave such items on the Property. Should the Property offer snorkel gear, body boards, surf boards, paddle boards, bicycles, a swimming pool, other sports or recreational equipment and any other items specially requested (collectively the “Equipment”), the Guest in consideration of being permitted to utilize the Equipment and/or Equipment provided by IBR, individually and/or collectively with the Owners, hereby agrees as follows: 1. Discharge and Covenant Not to Sue. The undersigned hereby releases, discharges and covenants not to sue IBR and/or the Owners, including but not limited to their respective heirs, trustees, successor trustees, principals, agents, employees, representatives, successors and assigns, and any others acting on their behalf, from any and all claims, liability and/or damages arising in any manner as a result of the undersigned’s utilization of any of the Equipment, including but not limited to ordinary negligence, gross negligence or strict liability, for personal injury, Property damage and/or death, further agreeing to defend, indemnify and hold the foregoing harmless from any such claims, liability and/or damages. 2. Risk. The undersigned further understands and acknowledges that certain dangers and risks will be present in the utilization of any of the Equipment, including, but not limited to (1) the risk of injury to the Guest and/or other resulting from utilization of any of the Equipment based upon the Guest’s lack of experience, familiarity, skill and/or training in the utilization thereof, (2) hazards which may exist on land or sea, many of which may not be apparent, (3) contact or interaction with other vehicles, equipment, persons or objects and (4) the actions of others utilizing any of the Equipment. The undersigned understands and acknowledges that such risk and danger can include injury or death to persons and/or damage to Property and expressly agrees to assume all such risks. 3. No Warranties or Representations. The undersigned further acknowledges that no one has made any representations or warranties concerning any of the Equipment. 6. ENERGY CONSERVATION Please be energy conscious, by turning off lights, fans, air conditioning (if provided), TVs, radios, etc. when leaving the unit. Installed or portable air conditioning may be an option for this Property if paid for and confirmed prior to guest arrival. If installed air conditioning is available for the Property, please do not leave the windows or doors open while operating the air conditioning. If the electric bill is over the average KWH per day for the previous (2) months of occupancy, Guest could be liable for additional charges for the AC. Guest must not turn the thermostat down below the suggested temperature for that unit. 7. LOST KEY REPLACEMENT / BEACH CLUB KEY CARD REPLACEMENT There is a $100.00 charge for replacement of lost keys (including the lock box key, if applicable) and $100.00 for a garage door opener. If Guest locks self out of Guest Property, there will be a $100.00 fee to send someone to open the Property. IBR will respond as soon as time permits. If Guest is staying at Mauna Lani Property and does not leave the Beach Club Key Card upon departure there will be a $150.00 charge for replacement of missing key card. 8. MAID SERVICE Guest safety and health is of highest priority to all of us here at IBR. Our company has implemented expanded cleaning protocols with our cleaning teams to follow recommended CDC guidelines and instructed our cleaners to be even more thorough with their cleaning and disinfecting measures. This includes but is not limited to thorough cleaning and sanitizing protocols for all high touch household common areas (including, but not limited to, remote controls, door knobs, keypads, etc.) as well as surfaces throughout each residence especially in the bathrooms and kitchens. Guest rental includes a cleaning fee for the cleaning prior to check-in on Guest CHECK-IN DATE and a cleaning following checkout of Guest on CHECKOUT DATE. If Guest would like additional maid service during Guest stay, please make arrangements with IBR prior to Guest arrival. PLEASE NOTE – A mid-stay cleaning and fee (assessed at half rate of rental cleaning rate) may be automatically assessed for any rental stays exceeding (14) nights. 9. MAXIMUM OCCUPANCY The maximum number of people including children is stipulated for this Property on AIRBNB website. PARTIES OR EVENTS ARE NOT ALLOWED ON THE PROPERTY. The maximum occupancy of the Property is (max count is included on AIRBNB website) persons. 10. NOISE Please keep in mind that Guest is in a very small and peaceful residential neighborhood. Noise carries over quiet landscapes and near water. IBR asks that Guest and Guest’s children respect Property neighbors' privacy, peace and quiet. Guests are asked to adhere to the “Good Neighbor Policy” as follows: A. Quiet hours shall be from 9:00 p.m. - 8:00 a.m. during which time the noise from the short term vacation rental shall not unreasonably disturb adjacent neighbors. B. Sound that is audible beyond the Property boundaries during non-quiet hours shall not be more excessive than would be otherwise associated with a residential area. 11. NON-SMOKING RENTAL This is a non-smoking rental. No smoking is allowed inside any of the buildings on the Property. No cigarette butts in gravel or yard. 12. PESTS (TO INCLUDE INSECT & RODENT CONTROL) IBR homes are treated on a regular basis; however, pests are a normal part of life in the tropics. Please let IBR know right away if Guest has any issues. IBR will do its best to remedy. The owner retains the services of a professional pest control company for the purpose of maintaining insect control in and around the premises, on a regular basis. However, this Property is in the "Tropics" and insects and rodents can be resistant to complete eradication. IBR cannot guaranty complete control over Mother Nature's insects and rodents and will not issue any refunds due to the sighting of insects and/or rodents. PLEASE KEEP SCREENS AND DOORS TIGHTLY CLOSED TO PREVENT PESTS FROM ENTERING THE HOME. 13. RUBBISH Please note that Guest is staying in a tropical environment and the best way to minimize pests is to keep food surfaces clean and dispose trash regularly. Please remove all trash to outside containers or take to trash site located on premises. Please see instructions in the guest book upon arrival. 14. SECURITY DEPOSI TO BE CONFIRMED if a security deposit will be required upon making Guest reservation. IF an additional security deposit is collected at time of reservation it will be returned within (14) days after check out as long as there is not any damage to Property found after guest departure. 15. SUPERVISION OF CHILDREN IBR is pleased that so many families come to stay with IBR and would like to ask that special attention be given to Guest’s children while they are in unfamiliar surroundings and in such close proximity to the ocean and a pool (if applicable to rented Property). DO NOT ALLOW SMALL CHILDREN TO PICK AND EAT ITEMS FROM THE YARD. GROUNDS ARE UNEVEN AND HAVE ROOTS PROTRUDING AND DIPS IN YARD. WATCH GUEST’S CHILDREN CAREFULLY WHEN ON DECKS OR STAIRS. Adults shall be responsible for the actions of children under their care and control. The GUEST is solely responsible for the actions of any and all minors (under 18 years of age) on the Property. The owner and the owner's managing agent accept no responsibility and or liability with respect to said minors, including the hazards associated with access to the ocean or the swimming pool (if applicable) on the premises. BE CAREFUL DURING HIGH SURF! Ocean conditions can be dangerous, high winds and high surf and high tides are cause to be cautious and enter at Guest own risk. If there is water sports gear or bicycles on the Property AND Guest is permitted to use them, the Owner and the Manager have no liability, see above. 16. SUPPLIES IBR will supply paper goods and soaps to get started. However, unlike a hotel, IBR is not responsible for replenishing Guest supplies beyond that. 17. TELEPHONE CALLS If a landline is available at the Property, there is no charge for local (Hawaii Island) phone calls. Please charge all off-island telephone calls to Guest’s credit card or home/business phone. Should Guest make any long-distance calls without billing them to another card or number, Guest will be charged a $30.00 service fee in addition to the amount of the calls. Many of IBR’s properties no longer have land lines so traveling with Guest’s cell phone is advised. 18. TRAFFIC Please DRIVE SLOWLY in our neighborhoods. The speed limits are 10 mph to 25 mph and there are many children and adult pedestrians and bicyclists. 19. USE OF PROPERTY Guest may use the home only as a place of vacation. Guest may not use it for commercial purposes, for any unlawful, improper, offensive purpose or illegal activity. Please refer to Guest Book upon arrival for details and instructions concerning use of pool, spa, and/or air conditioning if these amenities are available at the rented Property. POOL CARE (if applicable): The Pool sweep equipment must stay in the pool and not be removed. The pool sweep is set on a daily timer to run and must be kept on the schedule in order to keep the pool properly clean and safe to swim in. Additionally, guest shall not adjust or tamper with pool/hot tub/spa equipment, valves, controls, filters, pumps or water heaters. There will be a minimum $500 fee charged if the pool sweep is removed/damaged or any of the equipment, controls, etc. (as listed above) are adjusted or tampered with during Guest stay. WIFI: All of IBR’s homes have WI-FI, however, we are in the middle of the Pacific Ocean and there are outages due to weather or other conditions outside of IBR’s control. The manager does not offer technical support, however, IBR will do our best to help Guest. If Guest profession requires Internet while Guest stays with us, IBR suggests Guest bring personal hot spot to be sure of uninterrupted service. (AT&T and Verizon have the strongest signal) CIRCUIT BREAKER: Guest is not to alter or turn off the circuit breaker. 20. FURNITURE Guest agrees that if Guest re-arranges the furniture during Guest stay that Guest will return all furniture to its original position prior to Guest departure or be charged $250.00. 21. BEACH TOWELS There will be a $40 charge for each beach towel that is missing. 22. VALUABLES AND PERSONAL PROPERTY Take normal precautions for protection of Guest valuables. Understandably, IBR is not responsible for any losses. 23. FIRE HAZARDS The Guest hereby acknowledges that the Property is in a fire hazard area and that occupants must use due care in handling any and all flammable substances. Moreover, no explosives shall be allowed on the Property, including without limitation fireworks. Additionally, no open fires are permitted on or adjacent to the Property, and candles are not allowed. 24. NO PETS OR ANIMALS ALLOWED 25. NEIGHBORHOOD CONSTRUCTION IBR is not responsible for any construction noise or inconvenience that may occur during Guest stay. No refunds will be given. Although IBR cannot guarantee full knowledge of any planned or current construction occurring, Guest may contact IBR (90) days prior to Guest arrival to inquire if IBR is aware of construction adjacent to the Property occurring and Guest may choose to cancel at that time IF there is construction occurring that may affect the Property UNLESS Guest has already been made aware of construction during time of or shortly after Guest booking was made. 26. GUEST RESPONSIBILITIES Guest agrees to keep the unit and premises in clean, neat, safe and good order as well as pay for any damages caused by misuse or neglect. Any defect in the unit/home should be promptly reported to IBR. Guest agrees to leave the unit/home in clean and neat condition upon vacating. The Guest must allow the pool maintenance company (if applicable), the landscape maintenance company, trash service (if applicable) and the assigned cleaning person (if mid-stay clean is applicable to booking) to perform regularly scheduled weekly services. Please note, the dates and times for these scheduled services may vary. These scheduled details are available on site in the Guest Book and may be subject to change based on scheduling per agreement with Owner. At no time is the Guest to send a maintenance person away. These services are required to keep the property in top condition and the Owner has a contractual arrangement with the vendor. If Guest wishes to confirm details regarding scheduled services prior to arrival, please contact our office by phone or email. 27. MANDATORY EVACUATIONS If state or local authorities order a mandatory evacuation of any area that includes the Property, Guests shall comply with the order and evacuate the Property upon being notified and return all keys to IBR. Furthermore, Guest agrees not to return to the Property after the mandatory evacuation order has been lifted without consent from IBR. Please note that Guest will not be entitled to a refund from IBR. 28. RIGHT OF ENTRY Guest agrees that IBR or their representative may enter the Property during reasonable hours to inspect the Property, to make such repairs, alterations or improvements thereto as IBR or Property Owner deem appropriate. Furthermore, IBR reserves the right to enter the Property at any time to inspect for suspected commercial use or unlawful parties or pets, all of which are strictly prohibited. 29. OWNER AND IBR TO BE HELD HARMLESS The Owner and IBR accept no liability for any claims whatsoever arising out the Guest occupancy or that of their guests, invites and/or licensees. The Guest hereby agrees to indemnify, defend and hold harmless the Owner and IBR for any and all claims, damages, losses, PENALTIES, COSTS, CHARGES AND EXPENSES, INCLUDING REASONABLE ATTORNEY FEES ARISING OUT OF THE GUEST OCCUPANCY OR THAT OF THEIR GUESTS, Invites, AND/OR Licensees, INCLUDING WITHOUT LIMITATION ANY ACCIDENT, INJURY OR DAMAGES TO ANY PERSON OR PROPERTY OCCURRING IN, OR ABOUT THE SUBJECT PROPERTY OR ANY PART THEREOF ON PROPERTY. 30. HAWAII GENERAL EXCISE TAX / TRANSIENT ACCOMMODATION TAXES Hawaii general excise tax (4.712%), Hawaii State transient accommodations taxes (10.25%), and Hawaii County transient accommodations taxes (3%) are added to all reservations. 31. OTHER PROVISIONS Any items left behind by Guest will incur a $50 charge plus shipping costs to mail back to Guest. IF ANY OF THE ABOVE TERMS AND CONDITIONS ARE VIOLATED, ISLAND BEACH RENTALS, LLC. RESERVES THE RIGHT TO IMMEDIATELY EVICT GUESTS, RESULTING IN THE FORFEITURE OF ENTIRE RENTAL AND DEPOSIT AMOUNTS. ADDITIONALLY, ANY RELATED FINES ASSOCIATED WITH THESE VIOLATIONS WILL ALSO BE DEDUCTED FROM THESE AMOUNTS. THE UNDERSIGNED ACKNOWLEDGE THAT THEY HAVE READ, UNDERSTAND AND AGREE TO THE TERMS AND CONDITIONS OF THIS RENTAL AGREEMENT, AND AGREE THAT THESE TERMS APPLY TO ALL OCCUPANTS OF THE PROPERTY AND FURTHER ACKNOWLEDGE RECEIPT OF COMPLETED COPY HEREOF. PUAKO CONDO HOUSE RULES AND INFORMATION Puako Beach Condo HOUSE RULES & INFO SHEET Condominium living is a way of life. For condominium life to be satisfying and rewarding, we all need to have respect for each other, management and the House Rules. Ultimately these Rules will ensure that residents and their guests have the opportunity to live comfortably. House Rules are binding for all owners, their families, tenants and guests of the Condominiums. LANAIS AND ENTRYWAYS No smoking in the condos, lanais, pool, parking lots or anywhere on the condo property. Only appropriate lanai furniture and non-leaking potted plants may be used on the lanais. Lanais are not to be used for storage. Railings on the lanais and hall ways may be used to dry laundry although items may not hang down so it is visible to the lanai below. Please do not sweep debris onto the lanai below. ONLY PROPANE GAS may be used to grill or barbeque on the lanais. No gasoline, charcoal or deep fat fryers are allowed on the lanais. Care must be taken that gas barbecuing does not disturb others. Nothing shall be placed, stored or maintained on the walkways, sidewalks, parking areas, driveways, grounds or the common elements, nor obstruct transit through the common elements. NO skateboarding, roller skating, bicycle riding and related activities are allowed in the hallways, lanais, walkways, pool area or any common elements . PARKING Each condo has only one (1) parking space. Owners, tenants and guests may ONLY park in the space assigned to them. No street parking is allowed per the Short Term Vacation Rental regulations. IF Island Beach Rentals is able to secure a 2nd parking spot prior to or during guest stay, the second parking stall will be assessed at $25 (per day + credit card fees, if paying by credit card). The loading zone is for drop-offs and pick-ups and not for parking. Getting to and from the walkway is difficult with a vehicle parked in the loading zone. Only operating and licensed automobiles, light trucks and motorcycles are allowed in the parking lot. No boats, trailers or bicycles may be parked in the lot, nor is the lot to be used for storage of any items. Jet skis, ATVs, illegally jacked up vehicles, etc., are not allowed on the premises. Routine minor repairs to vehicles are allowed. Vehicles with oil or fluid leaks must be parked with a drip pan in place and must be removed each time you pull out until the leak is repaired. POOL There is no lifeguard on the premises. Everyone using the pool does so at their own risk. The Association does not accept any responsibility or liability for injuries or damages sustained by the use of the pool area. The pool is only for owners, tenants and guests and is open from 9:00 a.m. to 8:00 p.m. daily. Owners or their agents are responsible for the conduct of all family members, tenants and guests. Children must be accompanied by adults at all times while in the pool area. Before entering the pool, all must shower to remove dirt and sand. The following are NOT PERMITTED in the pool area: horseplay, running, diving, playing loud music or creating loud or disturbing noise. NO boogie boards, glass, rocks, balloons, or gum is permitted in the pool area. At managements discretion, other restrictions may apply. GENERAL PROVISIONS Interior and exterior masonry walls, floors and ceilings may not be changed or modified in any way that could impact the structural integrity of the building. Occupants must exercise extreme care and consideration regarding noise and in the use of musical instruments, radio systems, televisions and motor vehicles that may disturb other residents. Nothing is allowed to go down the toilets and drains that would interfere with the operation of the septic system. This means only toilet paper down toilets. All kitchen grease, seeds, coffee grounds and sand, Q-tips, condoms, towelettes, pads, wet ones, tampons, Clorox cleanups, dental floss, etc., are to be disposed of in the trash, not the toilet. Minimize the use of soaps, cleaners, bleach and water. Drano products are NOT ALLOWED. Absolutely no cleaning of paints, mortar, solvents, etc. is permitted inside of units. These all must be cleaned up at designated outside areas. No fireworks of any kind are permitted on the property. Guests agree to let gardeners, maids, pool cleaners etc. do their work as scheduled, please do not turn them away from the property. IF YOU ARE STAYING WITH ISLAND BEACH RENTALS AT MALULANI VILLA General HALE MALULANI VILLA Rules • NO crayons or magic markers for kids in the house! PLEASE! • Our sofa and chairs would be extremely expensive and difficult to replace and require a shipping container. Getting nice items shipped to Hawaii is quite a feat! Please take care of the furniture and house in general. • OPENING WINDOWS: Open regular door, then grip first window up high and pull towards you. Go to other side of sliding door, gently push door up, then release latch and swing out to stack by open door. • CLOSING WINDOWS: reverse the pull and pull from area where latch is, gently pulling down as you pull to release magnet at top. • SCREENS: Be gentle and pull. Sometimes wind in front of house will cause screen to come off the track. In that case, gently push screen top and bottom back into track while closing. • FANS: Please leave remotes on wall for fans and lights best that way! • PICKLEBALL: You are more than welcome to play with the balls and paddles we provide but please do so safely. We will not be responsible for any injuries or medical bills as a result of falls or trips. Be extremely careful of the metal edging behind the pickleball court facing the street. We urge you to wear court shoes and play at your own risk I • TELEVISIONS: We provide Spectrum, Peacock and HBO. We also have cords to charge the remotes behind the televisions. PLEASE do not remove the cords from the televisions! Please do not install your own programs without removing them. If you cannot locate your remote for TV, it may be plugged in behind the TV • KITCHEN FAN: Is above the island. The little round knob on the range operates the fan and light. It also has a mind of it's own. It goes off on a schedule to clear it out. It's ok, the house is not haunted. • APPLIANCE FOLDER: There is an Appliance folder under the wallpapered fish counter with instructions for the AGA oven and other appliances. • PRIVATE OWNER SPACES: Garage, owner's pantry and owner's closet are private. Thank you! General MALULANI VILLA Information Aloha and welcome to Malulani Villa! We hope you enjoy it as much as we do and would like to point out a few wonderful things for your enjoyment. • We get views of sunsets 365 days a year. Most homes do not. • Whale watching here is the best! Usually Nov – March. • We have an ancient Hawaiian petroglyph game out on the lava in front of the house on the ocean. • People will walk, fish and swim out in front of the house, it is public access. • Sometimes people fish at night so if you see a flash light out by the water, it is most likely a fisherman. • The Honus (turtles) like to swim up onto this lava shore and all along this street. • Paniau is the park just 3 houses past ours to the south. It is a great place to launch snorkeling, paddle-boards and surf boards. • If you keep walking past Paniau, you come to the Fairmont Orchid and past that, the Mauna Lani Beach Resort. Some coral but easy walks and wear your suit if you want to jump in along the way. • This is the most wonderful road. People here are friendly and kind. We know you will enjoy your stay. • Please take a look at the book, Hawaii, The Big Island Revealed which we have left for you. So much history and good information contained in there.
