Huge beachfront home located beachfront at Cape San Blas. No worries about beach crowds here!! Come enjoy the solitude of Cape San Blas in our 6 bedroom/4 bathroom home. Our home also offers a private saltwater pool, private boardwalk, large screened in porch and third floor sundeck with panoramic views of the gulf. Please inquire about our monthly discount available in December, January and February. Our home is large enough for 14 guests to all enjoy together time and find a quiet spot when necessary. You will have access to our whole home with the exception of an owner's closet and housekeeping closet. During your stay, I will always be just a text, email or phone call away from answering any questions and tending to any unexpected needs. Our home is located in a quiet neighborhood on the south end of Cape San Blas. You will need your own car to access Cape San Blas. Public transportation is not available. Please note that there is a fee of $350 for pool heat for the week. The fee is seasonal (October 1 - May 1). The fee is an add on fee after receiving your reservation. It is not included in the rate quoted. 1. CHECK-IN TIME is AFTER 5 P.M. EST AND CHECKOUT is 10 A.M. EST. NO Early check-in or late checkout. 2. This is a NON SMOKING house. No smoking in the house, on the decks or at the pool area. 3. NO PETS ALLOWED. Pets are not permitted in house under any conditions. 4. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. 5. DAMAGE/SECURITY DEPOSIT - A security deposit of $500 is required. The deposit is NOT applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met. • Follow ALL check out instructions provided to guest upon making final payment. • Maximum occupancy of 14 guests is not violated. Occupancy will be verified during stay. • No damage is done to house or its contents. • No items are flushed down toilets other than toilet paper. Our home has a septic system. Flushing feminine products, condoms, wipes, etc. down toilets will cause a system back up. • No items are removed from house including towels, sheets, Tupperware, etc. • All trash is placed in outdoor trash can. • All dishes are washed and returned to cabinets. • All beach towels are washed, folded and returned to cabinet. • Refrigerator is cleaned of all remaining food. • No linens are lost or damaged. • Bed linens and bath towels are not used at the pool or beach. • All dirty/wet bath towels are left on the laundry room floor. • All dirty sheets are left on the laundry room floor. • No tampering with the pool equipment. • No fish cleaning in the house. Any fish cleaning debris should be bagged and placed in outside trash can. • No early check-in or late checkout. • The renter is not evicted by the owner (or representative of the owner) or the local law enforcement. Loud parties are not permitted. This is a residential neighborhood. 6. DAILY/WEEKLY RENTAL PAYMENTS – An advance payment equal to 50% of the rental rate is required at the time of booking. The advance payment will be applied toward the room rent. The BALANCE OF RENT is due fourteen (14) days before your arrival date. 7. DAILY/WEEKLY RENTAL CANCELLATIONS – All cancellations received at least 60 days in advance of the arrival date will receive a full refund. All cancellations received at least 30 days in advance of the arrival date will receive a 50% refund. 8. MAXIMUM OCCUPANCY – The maximum number of guests is limited to 14 people including children and adults. 9. MINIMUM STAY – A minimum stay of 3 nights is required. 10. INCLUSIVE FEES – Rates include a one-time linen and towel setup. 11. NO DAILY HOUSEKEEPING SERVICE – While linens and bath towels are included, daily maid service is not included in the rental rate. 12. RATE CHANGES – Rates subject to change without notice. 13. FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in. 14. WRITTEN EXCEPTIONS – Any exceptions to the above mentioned policies must be approved in writing in advance. 15. STORM POLICY – No refunds will be given unless: • The state or local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or • A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest. • The day that the authorities order a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund: Any unused portion of rent from a guest currently registered; Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted; and Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period. . 16. TRAVEL INSURANCE – We highly recommend all guests purchase travel insurance. This house is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. 17. TERMS OF OCCUPANCY - The rented property is a private residence and you agree to indemnify the owner for any damage or loss to the property or its contents that occur during your stay. Violation of occupancy limits will result in the forfeiture of all monies and termination of occupancy. We reserve the right to inspect the property during your stay. The owners of 106 East Sand Dollar Way are not liable for inoperable pool or failures of any equipment, systems, or appliances, as major repair problems cannot be foreseen. There are no rebates or refunds issued to Tenants for any reason as every good faith effort is made to insure the property is maintained to highest standards. Renter(s) is responsible for any damage incurred during his occupancy of the premises. Tenants are expected to care for the property as if it were their own. Tenant acknowledges that unless Owner is notified on day of check-in of any damage or cleaning concerns, then thereafter, all damages or concerns to the property during the occupancy will be Tenants responsibility and must be reported to Owner and paid prior to departure. 18. LOCKED AREAS for which Tenant is not provided a key, such as owners personal storage areas, are exempt from this lease agreement and are off limits to the Tenant. Forced entry into these areas is cause for immediate termination and Tenant will be charged for damage and/or missing items. 19. INDEMNITY. The Tenant agrees to release and indemnify the Owner and its Agent from and against all liability, should anyone be injured upon the premises during the term of the lease, resulting from any cause whatsoever, except in the case of personal injury caused by the negligent act of the Owner, his Agent or the Agent’s employees. 20. IN THE EVENT that the Owner is unable to deliver said property to Tenant under this lease agreement prior to occupancy because of fire, eminent domain, act of nature, double booking, delay in construction or any other reason whatsoever, Tenant hereby agrees that Owner’s sole liability as a result of these conditions is a full refund of all consideration previously tendered by Tenant. This document shall serve as the complete agreement between Renter and Doug and Jennifer Squire, property owners of 106 East Sand Dollar Way. Entrance into 106 East Sand Dollar Way constitutes acceptance of this agreement. Acceptance of this agreement certifies that I have read, understand, and agree to the rental terms as printed above. I certify that I am solely responsible for all damages to the property during the rental period. Further, I certify that I am over 25 years of age and I will be one of the occupants during the rental period. COVID19 ADDENDUM: Please understand that additional cleaning is necessary for unit to be ready for your stay. Absolutely no early check in or late check out will be allowed for the safety of all guests and housekeeping staff. Some decorative items have been removed to limit surface exposure to any potential infectants. These items include: decorative pillows, throw blankets, etc. The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization and the Center for Disease Control (CDC). COVID-19 is extremely contagious and is believed to spread mainly from person to person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. The Lessor cannot guarantee that tenant, its family, or guests will not become infected with COVID-19 while using the leased property. Tenant acknowledges that the Lessor does not carry liability insurance providing coverage for contracting an infectious disease. Tenant also acknowledges the contagious nature of COVID-19 and voluntarily assumes the risk that tenant and all members of their party may be exposed to or infected by COVID-19 while using the leased property and that such exposure or infection may result in personal injury, illness, permanent disability, and death. Tenant agrees to assume all of the foregoing risks and accept sole responsibility for any injury to itself, members of its party and guests (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind that we may experience or incur in connection with our use of the rented property. Tenant hereby releases and covenant not to sue, discharges, and agrees to defend and hold harmless the Lessor from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto to the contraction of the coronavirus infection or COVID-19. Tenant understands and agrees that this release includes any claims based on the actions, omissions, or negligence of the Lessor, its employees, agents and representatives, whether a COVID-19 infection occurs before, during, or after the lease term. Tenant acknowledges the contractual assumption of the risk as set forth herein is a specific condition of Lessor agreeing to lease the property. Tenant acknowledges this is a specifically negotiated term and monetary amount of the lease is specifically based upon the inclusions of this provision.
