Right outside the front door is a 22in electronic Blackstone where you can make pancakes and bacon for breakfast, grilled cheese for lunch, or steaks for dinner! The griddle is the limit for whatever you desire. Natural wood floors span the entire Treehouse to envelope you in the warmth of nature. Live edge wood shelves adorn the entire Treehouse, truly keeping nature alive. The custom built in bench is the perfect place to relax and enjoy a cup of coffee or tea while you look out the stunning picture frame windows amongst the trees from every angle. Our custom coffee table brings the lake and the woods together to double as your dining table and as extra prep space for cooking. The bathroom is fully stocked with everything you will need for your stay. The gorgeous custom blue tile shower is a perfect place to wash off a day of outdoor adventures. As you venture your way up the Treehouse steps you are welcomed into your charming and relaxing loft retreat. As you lay in the queen size luxury bed you can look out the skylights and observe nature day and night. If you want to unwind with a movie or show, the 100-inch projection screen will come down and you can log in to your accounts stream anything your heart desires. The balcony off the bedroom is a great place to enjoy a glass of wine in the evening and watch the sun set over the lake, or start your day with a hot cup of coffee and listen to birds chirping among you. To accommodate an additional 2 people we have a Invation EZ-bed Queen Air mattress! The Queen size mattress has a built in pump that self inflates and deflates in under 4 minutes! You are able to adjust the firmness to your liking. The Queen size mattress when inflated will be located in the main living space of the Treehouse. Back out on the deck let your inner child come out and cross over the bridge to your very own lookout! Nestled in the midst of the trees you have 360 degree views of the best nature has to offer. Every inch of the bathroom is custom in rustic greens and browns, and is fully stocked with everything you will need for your stay. We are not physically on property but 24/7 always a call or text away! The Hocking Hills is a four-season nature resort, with every season having something of its own to offer our guests who travel from near and far. Whether you are coming to hike in the spring and summer, experience fall colors, or try out winter activities, Hocking Hills has an experience just for you. This Short-Term Rental Agreement (the "Agreement") is made by and among Barger Property Management LLC, an Ohio limited liability company and BPV Lake LLC, an Ohio limited liability company dba Barger Property Ventures and/or The Oasis at Hocking Hills (collectively "Operator") and the undersigned (collectively “Guest”) effective as of the date last set forth on the signature page of this Agreement or the date electronically accepted by both parties on the applicable vacation rental website, if applicable, (the “Effective Date”). For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 1. RENTAL. Operator hereby leases to Guest and Guest hereby leases from Operator the following property (the “Property”) upon the terms conditions set forth herein. Please refer to your booking details for the property address, arrival and departure date and information, rental amount, and maximum number of guests. 2. CHECK-IN/CHECK-OUT. Check-in and Check-out times for the Property are as follows: Check-In: 4:00 PM Check-Out: 10:00 AM 3. RESERVATION/CANCELLATION POLICY. Guest must be at least twenty-one (21) years of age to reserve and rent the Property. Photo identification is required at the time the reservation of the Property is made. Payment of the full Rental Amount is due upon booking. A fifty percent (50%) refund of the full Rental Amount will be given for cancellations made at least thirty (30) days prior to the Arrival Date. For any cancellation made within thirty (30) days of the Arrival Date, no refund will be provided. No refunds will be provided for cancellations due to inclement weather. 4. METHODS OF PAYMENT. Operator accepts Visa, MasterCard, Discover and American Express credit cards for rentals. A major credit card is required at the time of reservation which will be kept on file for any damages to the Property, and for pet deposits and/or any security deposits. 5. HOURS OF OPERATION. Operator’s hours of operation are 8:00am - 5:00pm EST Monday to Friday, excluding federal holidays. Operator shall make diligent efforts to respond to all inquiries within one (1) business day of such inquiry. 6. INDEMNIFICATION AND WAIVER. Operator maintains its properties with the utmost care and regard for guest safety. All guests are responsible for their own actions, those of their invitees and the actions of any minor children during the course of their stay at the Property. Guest agrees to indemnify, defend, and hold harmless Operator, its members, managers, employees, agents and contractors for any and all claims, losses, injuries, accidents, damages, or occurrences in or about the Property during Guest’s stay, including reasonable attorney’s fees. Some properties have multiple acreage and offer private hiking or walking trails. Guest and their invitees assume all risks associated with hiking and walking, and should only use the areas that are designated by the applicable owner or operator of such areas for such activities. 7. MINIMUM STAY REQUIREMENT. During non-Peak Season (as defined herein) , there is a 2- night minimum stay requirement for rentals of the A-Frame and Lodge, while all other properties have a 1-night minimum stay. During “Peak Season” (June 1 through November 30), rentals of the A-Frame and Lodge properties carry a 3-night minimum stay, and the treehouse properties carry a 2-night minimum stay on weekends, which are defined as Friday check in-Sunday check out. Notwithstanding anything to the contrary contained herein, “Peak Season” shall also include the following: Memorial Day, Independence Day, Labor Day, Thanksgiving , Christmas, and New Year’s Eve. 8. GENERAL POLICIES. No refunds will be given due to inclement weather conditions, mechanical failures at the Property, absence of any items at the Property, public utility interruptions, or for early departures. Operator recommends Guest use of 4-wheel drive vehicles in the winter season. The Property will be inspected prior to your arrival. No student groups, house parties or receptions are allowed at the Property. If Guest or their invitees are found to be having a party, they will be required to vacate the Property and no refund will be given. Absolutely no fireworks shall be set off at the Property, nor should any fires be maintained outside of the designated fire pits. At no time should furniture be moved inside or outside the Property. The Property shall be returned to Operator at the Departure Date in the same condition as it was on the Arrival Date. An additional cleaning fee will be charged to the extent excessive cleaning is required to return the Property to Arrival Date condition subsequent to Guest’s departure. Guest acknowledges Operator may install and maintain security cameras on the exterior of the Property. 9. DISCOUNTS. Only 1 discount code can be applied to a rentalstay. Discounts may not be combined, nor can they be applied to special packages. 10. PETS. Pets are not authorized at the Property. Discovery of an unauthorized pet and/or necessary cleaning and/or damages resulting from the same will result in a $300.00 fee charged to the credit card on file in addition to the actual costs to repair any damages caused by such pet. 11. SMOKING. Smoking is prohibited inside the Property. Discovery of smoking inside the Property will result in a $500.00 fee charged to the credit card on file in addition to the actual costs to repair any damages caused by such smoking. 12. LOST ITEMS AND LOCK OUTS. Please remember to check for belongings that may be left behind prior to your departure. Left behind belongings found by housekeeping will be kept for no more than thirty (30) days. There will be a $25.00 fee plus shipping to return any left behind items charged to the credit card on file. If you require assistance getting into a unit during your stay from your host, a $100.00 fee will be added. 13. EARLY AND LATE CHECK IN/OUT. You will need to provide advance notice to your host if you wish to have an early check in or a late check out. Check ins up to 2 hours in advance of 4:00pm and check outs up to 2 hours after 10:00am may be permitted for a $50.00 charge. If you enter early or leave late without making prior arrangements, this charge will be processed. 14. EQUIPMENT, MECHANICALS AND FURNISHINGS. Any issues with operation of equipment or mechanicals servicing the Property must be reported immediately to Operator. Repairs to equipment, mechanicals and/or furniture will be made by Operator within commercially reasonable time periods. All equipment, mechanicals and/or furnishings have been inspected prior to your stay and deemed in good working order. The same will be inspected subsequent to your Departure Date and are required to remain in materially comparable condition. Any damage to furnishings, mechanicals, or equipment will result in Guest being charged for the cost to repair or replace the same and charged to the credit card on file. Only use Property appliances for their intended uses. Guest shall be required to return the Property to Operator in a condition materially comparable to that as of the Arrival Date. As such, an extra cleaning fee may be charged to Guest to the extent housekeeping for the Property is required above commercially reasonable levels upon Guest’s departure. 15. LINENS, SUPPLIES AND TRASH. Bed linens and bath towels are provided to the Property along with basic kitchenware and utensils. Operator shall supply commercially reasonable quantities of trash bags, paper towels, bathroom tissue, dish and hand soap. Operator recommends that Guest bring a flashlight and lighters for use at the Property. Please do not remove any of the Operator provided items from the Property or from their location at the Property. Upon departure, Guest is responsible for taking all trash to the designated dumpster. Failure of Guest to remove trash shall result in a $200 fee which shall be charged to the credit card on file. An additional cleaning fee will apply to any building left excessively dirty. There is no daily housekeeping or linen service. While linens and bath towels are included at the Property, daily maid service is not included. Operator suggests Guest bring beach towels for use during their stay. Operator does not permit towels or linens to be taken from the Property for outdoor use or otherwise. 16. OUTDOOR GRILLS. The Property comes with a griddle and/or grill and the basic items for its use. 17. FIREPLACES. Some properties operated by Operator have indoor gas fireplaces. Please do not open or put anything into the gas fireplace. Do not leave fireplaces on overnight. Some properties operated by Operator contain outdoor gas or wood burning fireplaces. At no time may Guest or its invitees cut wood on the Property. If Guest would like to purchase fire wood for use at the Property, Guest may select the same as an additional service during booking. Please comply with all safety precautions and/or applicable codes or regulations which are posted at the Property for proper fireplace or fire pit use. All dampers should be opened when the fireplace is in use. Fires should never be left unattended in at the Property. 18. OCCUPANCY AND NOISE. Please limit occupancy to the number of occupant set forth in Section 1.4 herein. An additional occupancy rate shall be charged if additional occupants access the Property at the rate of $100/per night/per person, which shall be charged to the credit card on file. Additional guests are not permitted at the Property. Any noise complaint may result in immediate termination to access to and occupancy of the Property with a loss of all rental amounts and deposits paid. Guest and their invitees shall not make or permit loud or disturbing noises, whether music or otherwise, at any hour and shall abate such noise between 10:00 pm and 7:30 am upon request by any person. Please note that open spaces can amplify and carry voices and noises, including indoor noise with open doors or windows, stomping feet and cell phone conversations. Loud televisions and stereos may carry through walls and between floors. No parties or gatherings of any type are allowed without written permission of Operator, which may be withheld at Operator’s sole discretion. The Property is to be used for short-term residential purposes only. 19. HOT TUBS. The hot tub, if any, located at the Property may not be at full temperature upon Guest’s arrival. Hot tubs are drained and sanitized and take hours to heat to full temperature. Hot tubs should not be used at temperatures greater than 104F. Please comply with all safety instructions posted at the Property. Guest and their invitees are not permitted to change any settings other than the temperature and jet settings of the hot tub. A $100 cleaning fee may apply to hot tubs left excessively dirty, such fee which shall be charged to the credit card on file. 20. WATER AND SEPTIC. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that feminine products or anything else has been flushed and clogged the septic system, you will be responsible for any and all damages with no limit. You will be responsible for any plumbing charges caused by clogged toilets. 21. ADDITIONAL TERMS AND CONDITIONS. 21.1. The terms of this Agreement are in addition to those terms and conditions provided by any vacation rental website. In the event of any conflict between the terms and conditions of this Agreement and the terms and conditions of any vacation rental website, the terms of this Agreement govern and control. 21.2. Fines/fees/damages/payment: Guest agrees to accept responsibility for any fines, fees or damages to the Property caused by or due to Guest or their invitees during their stay, without limitation, in addition to payments specifically provided for under this Agreement. Guest agrees to reimburse Operator for the cost of any reservations that must be canceled due to damages caused by Guest or their invitees. Guest acknowledges that they will be responsible for all costs incurred by Operator to enforce this Agreement including litigation, court costs and attorney fees and interest at the rate of 18% per annum for any amounts due and unpaid by Guest. 21.3. Access: Guest shall allow Operator access to the Property for purposes of repair and inspection at all times during their stay. 21.4. Credit card authorization documents: Guest will be required to provide a credit card authorization form as well as copies of the front and back of the credit card used and the front of a government ID. Failure to provide the same to Operator within 24 hours of request can result in cancellation of Guest’s reservation. 21.5. Refunds: No refunds are made for any reason within thirty (30) days of arrival. No cancellations, changes or modifications to reservations are allowed for any reason. 21.6. Operator cannot guarantee against mechanical failure of wifi, air conditioning, heating, TV, Satellite Receiver, DVD player, swimming pool, stereo systems or any other appliances or amenities. Please report any inoperative equipment immediately upon check-in to Operator. Operator will make commercially reasonable effort to have repairs completed in a timely manner but no refunds or rent reductions will be made due to failure of appliances or equipment or for any reason. 21.7. Waivers, limitations of liabilities, covenants not to sue: For good and valuable consideration in executing this Agreement the sufficiency of which is hereby acknowledged, Guest hereby remises, releases, and forever discharges, and by these presents does, for himself/herself and for his/her heirs, executors, administrators, assigns and Guest’s invitees hereby remises, releases and forever discharges Operator, its managers, officers, owners, directors, shareholders, members, their respective heirs, executors, administrators, agents, successors and/or assigns, and all other persons, patrons, sponsors, supporters, volunteers, employees, firms or corporations (hereinafter referred to as the “Released Parties”) who are or might be liable, of and from any and all claims, demands, rights, causes of action, actions, damages, costs, expenses and compensation, of whatever kind or character, arising from or by reason of any and all known or unknown foreseen, bodily or personal injury, loss and damage to property, wrongful death, and the consequences thereof, resulting from, any occurrence or casualty under this Agreement and in relation to the Property and/or use thereof including but not limited to, any hot tubs or swimming pools. Guest covenants for his/her invitees, himself/herself, his/her respective heirs, legal representatives, and assigns, to irrevocably bind himself/herself to refrain from making any claim or demand, or to commence, cause or permit to be prosecuted any action in law or equity against the Released Parties or any other person, firm or entity claiming by or through them, on account of any occurrence or casualty under this Agreement. Guest expressly agrees that this instrument may be treated as a defense to any action or proceeding that may be brought, instituted, by Guest or in his/her behalf, and shall forever be a complete bar to the commencement or prosecution of any action or proceeding whatsoever against the Released Parties or any other person, entity or firm claiming by or through Guest or his/her invitees. This waiver and release is intended to include all expenses of litigation, costs, attorney’s fees and any other expenses related to any occurrence or casualty under this Agreement. Guest for himself/herself and for his/her invitees, heirs, executors, administrators and assigns, does hereby covenant and agree with each of the Released Parties to indemnify, defend, and save harmless the Released Parties and their respective heirs, administrators, executors, agents, insurers, transferees and assigns, from any and every claim or demand of every kind or character henceforth made or asserted by any person, firm or corporation on account of or in any way growing out of any and all injuries and damages to or sustained by Guest as a result of said occurrence or casualty. 21.8. Guest hereby represents, declares, and agrees that he/she is over the age of twenty one (21) years and legally competent to execute this Agreement and that the terms of this Agreement have been completely and carefully read and are fully understood. As used herein, the singular number shall include the plural, the plural the singular and the use of the masculine, the feminine, and the neutral gender shall include all genders, as the context may require. Invalidation of any one or more of the provisions of the Agreement shall in no way affect any of the other provisions hereof, which shall remain in full force and effect. Neither this Agreement nor any term, in no way affects any of the other provisions hereof, which shall remain in full force and effect. Neither this Agreement nor any other term, condition, covenant, or agreement, hereof may be changed, waived, discharged, or terminated orally but only by an instrument in writing signed by the party against whom enforcement of the change, waiver, discharged, or termination is sought. Guest further states that this Agreement contains the entire agreement between the parties hereto, and the terms of this release are contractual and not a mere recital, and that Guest signs the name as his own free act and deed. 21.9. No Construction Against Drafter. Each party has participated in negotiating and drafting this Agreement, so if an ambiguity or a question of intent or interpretation arises, this Agreement is to be construed as if the parties had drafted it jointly, as opposed to being construed against a party because it was responsible for drafting one or more provisions of this Agreement. Each party expressly acknowledges that they have had a sufficient opportunity to consult with and receive the advice of an attorney concerning all portions of this Agreement. In addition, each party acknowledges they freely and voluntarily execute this Agreement. 21.10. This Agreement and the exhibits attached hereto contain the entire agreement of the parties with respect to the subject matter of this Agreement, and supersede all prior negotiations, agreements and understandings with respect thereto. This Agreement may only be amended by a written document duly executed by all parties. 21.11. If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Agreement shall remain in full force and effect. 21.12. Non-Waiver The failure by one party to require performance of any provision shall not affect that party's right to require performance at any time thereafter, nor shall a waiver of any breach or default of this Agreement constitute a waiver of any subsequent breach or default or a waiver of the provision itself. 21.13. Acceptance of the Property: Operator has not made and does not make any representations as to the cleanliness, suitability, physical condition, layout, footage, expenses, operation or any other matter affecting or relating to the Property and this Agreement, except as herein specifically set forth or referred to and Guest hereby expressly acknowledges that no such representations have been made. Operator makes no other warranties, express or implied, of merchantability, marketability, fitness or suitability for a particular purpose or otherwise, except as set forth herein. Any implied warranties are expressly disclaimed and excluded. 21.14. Force Majeure. In no event shall Operator be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, and interruptions, loss or malfunctions of utilities, governmental orders, epidemic or pandemic, inability to procure labor or materials, communications or computer (software and hardware) services. 21.15. Headings. Headings appear solely for convenience of reference. Such headings are not part of this Agreement and shall not be used to construe it. 21.16. Execution and modification. This Agreement is binding only when signed by both parties. Acceptance of the agreement on any web site by Guest shall constitute a signature. Any modifications or amendments must be in writing and signed by both parties. 21.17. Relationship: Guest acknowledges that this Agreement does not create a landlord-tenant relationship with Operator and Guest and their invitees have no rights of tenancy. 21.18. Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not included within the number of and as permitted occupants under this Agreement. 20.19. Credit Card Charge Authorization The undersigned authorizes charges on my credit card(s) for a reservation with Operator in accordance with Section 1.3 of the Agreement (the “Rental Amount”). The Rental Amount may be paid on one or more credit cards. The undersigned acknowledges that there are no refunds for cancellations, no-shows, late arrivals or early departures or any other circumstances whatsoever within thirty (30) days of arrival. In addition to the Rental Amount, the undersigned also authorizes additional charges to be charged to the undersigned’s credit card(s) for fees and damages as set forth in this Agreement.
